1. The contract between us

The contract is formed between you and Roots 2 Success when Roots 2 Success notifies you by email and/or electronically that your registration has been accepted.

2. Ownership of rights

All rights, including copyright, in this website are owned by Roots 2 Success. Any use of this website or its contents or downloads obtained via this website, including copying or storing it or them in whole or part, other than for your own personal, non commercial use, is prohibited without our permission. You may not modify, distribute or repost anything on this website for any purpose.

3. Accuracy and relevance of content

3.1 Every effort is made to ensure the accuracy of  information on this website, but accuracy cannot be guaranteed as school and 11 plus information changes from year to year.

3.2 The online tests have been developed to assist children in preparing for the 11 plus exam, but the materials in this website should not be considered as a complete and comprehensive collection of the materials necessary for 11 plus success.

3.3 Although high marks in Roots 2 Success online tests may indicate that a child has a realistic chance of passing the 11 plus, no guarantee can be made that good performances in these tests will ensure that a child will pass the 11 plus.

4. Damage to your computer

We try to ensure that this website is free from viruses or defects. However, we cannot guarantee that your use of this website or any websites accessible through it will not cause damage to your computer. It is your responsibility to ensure that the right equipment is available to use the website. Except in the case of negligence on our part, we will not be liable to any person for any loss or damage which may arise to computer equipment as a result of using this website.

5. Availability

Roots 2 Success aims to ensure that the online tests are available 24-hours a day, however there may be occasions where content is not available due to technical problems with the website server. In the event of any such occurrence Roots 2 Success will ensure that service is restored as soon as possible. In the unlikely event of a long term or permanent cessation of service you will be entitled to a refund of unused website credits.

6. Registration

6.1 When you register as a user, you will be required to provide information about yourself and Your Authorised User e.g. name and contact details as part of the registration process. You warrant that any registration information that you provide to Roots 2 Success will be accurate, correct and up to date and shall continue to keep such information up to date and accurate.

6.2 Upon duly completing the relevant registration process and creating a Username and Password, you and/or Your Authorised Users will be registered as a user of Roots 2 Success. 

6.3 You agree to and agree to procure that Your Authorised User does not make available the Username and Password available to anyone. Where such disclosure of the Username and/or Password occurs, you must inform Roots 2 Success immediately and change your Password. In addition, where you wish to terminate the contract with Roots 2 Success, you agree to inform Roots 2 Success so that Roots 2 Success can update its system.

6.4 If you or Your Authorised User uses a shared computer, you agree that neither you nor they will save the Username and/or Password on such computer.

7. Links

7.1 The Website may include hyperlinks to other websites or content or resources. You acknowledge and agree and shall procure that Your Authorised User acknowledges and agree that:

7.2 Roots 2 Success has no control over any such websites;

7.3 Roots 2 Success is not responsible for the availability of any such external linked websites or resources; and

7.4 Roots 2 Success does not endorse such websites or resources and as such, Roots 2 Success will not liable for any loss or damage which may be incurred by you and/or Your Authorised User (as the case may be) as a result of the non-availability of such external websites or resources, or as a result of any reliance placed by the you and/or Your Authorised User on any materials and/or information obtained from external websites or resources.

8 Payment terms

8.1 Payment for website credits, digital downloads or mock exams is made by debit or credit card. Website credits and digital downloads will be available immediately after payment.

8.2 Website credits and digital downloads may only be purchased by UK customers.

9. Cancellation rights

9.1 Under the distance selling regulations you have the legal right to cancel your order within fourteen days of setting up your account and purchasing credits. However only the cost of unused credits can be returned to you; payment for digital downloads cannot be refunded. You do not need to give us any reason for cancelling your contract. However, you will need to notify us if you wish to cancel your contract.

9.2 Once you have notified us that you are cancelling your contract, the cost of any unused online test credits debited to us from your credit or debit card will be re-credited to your account as soon as possible and in any event within 30 days of your order. 

10 Notices

Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be in writing and sent to our contact address in the first paragraph of these terms and conditions and all notices from us to you will be displayed on our website from to time. 

11 Changes to legal notices

We reserve the right to change these terms and conditions from time to time. Any changes to terms and conditions will be displayed on this website and will be notified to registered users by email.

12 Law, jurisdiction and language

This website, any content contained therein and any contract brought into being as a result of usage of this website are governed by and construed in accordance with English law. Parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England and Wales. All contracts are concluded in English.

13 Invalidity

If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.

14. Privacy

Information you provide to us will be stored securely and will not be shared with any third party. The information will be used solely for the purposes of providing you with the services described in this site and for providing you with information about any additional services which may become available.

15 Third party rights

Nothing in this Agreement is intended to, nor shall it confer any rights on a third party.
